These terms and conditions (these “Terms”) apply when you submit photographic, text or other digital content (your “Moment”) via Ronald McDonald House Charities’ (“RMHC”) website www.rmhc.org.uk (the “Website”). By submitting your Moment, you agree to accept these Terms.
Submitting your Moment:
You are only entitled submit your Moment if you are: (i) over the age of 18; or (ii) over the age of 14 and have the consent of your parent or guardian. You must be a resident of the UK to submit your Moment and you must have the consent of: (i) everyone depicted, featured or otherwise referred to in your Moment; and (ii) the parent or guardian of anyone depicted, featured or otherwise referred to in your Moment if that person is under 18.
A Moment will describe an experience you have had with RMHC and what it means to you. Submission can only be accepted via completion of the online form provided available on the relevant section of the Website and on RMHC’s receipt of the requested information about you (“Your Data”).
You warrant and undertake that Your Data is correct and relates directly to you and not to any third party. Proof of identity, age or other elements of Your Data may be required after submission. Use of a false name or age or failure to comply with these Terms will result in your Moment not being published on the Website. Entries made online using methods generated by a script, macro or the use of automated devices or other technologies will be void.
Your Moment going live:
During the course of the Moment campaign, RMHC will review submissions and may upload Moments to the Website. RMHC reserves the right to review, edit, amend or alter any Moment in its sole discretion for any reason, including the right to remove a Moment from the Website. RMHC will endeavour, but shall not be obliged, to notify you by email if it decides to create and display your Moment and/or to use your Moment for any purpose including in any RMHC marketing, advertising, communications or other campaign.
By submitting your moment, you are agreeing that RMHC has the right to share the content you upload with their agencies and McDonald’s Restaurants Ltd.
The submission of a Moment, its style and structure (once live on the Website) and the materials and information which form part of it belong to RMHC and are protected by copyright and other intellectual property rights, and may not be used by you except as expressly provided in these Terms. “Intellectual property rights” means all patent rights; copyright rights; moral rights; rights of publicity; trade mark, trade dress and service mark rights (and associated goodwill); trade secret rights; and all other intellectual property and proprietary rights as may now exist or hereafter come into existence, and all applications for any of these rights and registrations, renewals, and extensions of any of these rights, in each case under the laws of any state, country, territory or other jurisdiction.
By submitting your Moment, you hereby grant RMHC a non-exclusive, royalty free, transferable licence in perpetuity to use your Moment (as provided to or as amended by RMHC), your first name and your local town or county, submitted as part of Your Data, in any media and for any purpose whatsoever for no payment or other consideration. You waive all moral rights that may exist in a Moment.
You warrant to RMHC by submitting your Moment that: (i) it is your original work and it has not been copied from any other source and that it will not infringe the rights of any third party or any right of privacy, publicity or personality or any other right, whether registered or unregistered, of any other nature or any person; and (ii) your Moment is not obscene, libellous, blasphemous, sexist, racist, anti-religious, homophobic, bullying, harassing, violent, sexual, defamatory or otherwise unacceptable content, in RMHC’s sole opinion. You agree to indemnify and hold harmless RMHC, it’s owners, shareholders, officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), arising out of or in any way related to (i) your access to or use of the Website, (ii) your Moment, or (iii) your breach of any of this term.
RMHC’s use of Your Data:
Other than as set out in these Terms, RMHC shall use Your Data solely for the purposes of administering the campaign, unless you have indicated a preference to receive news and offers from RMHC.
If you wish for Your Data which is under RMHC’s control to be deleted at any time, you can request deletion by emailing Katie.Herbert@uk.mcd.com.
RMHC does not guarantee continuous uninterrupted access to the Website. Numerous factors outside of RMHC’s control may interfere with the operation of the Website. No responsibility will be accepted for any technical or other difficulties in making your Moment submission or for a delayed or corrupted Moment submission.
You are responsible for all costs and expenses relating to your participation in the campaign, such as the cost of accessing the Internet, including by mobile phone.
Except as otherwise required by applicable law, RMHC shall not be liable for the content of any externally linked websites.
RMHC reserves the right to amend or alter the Terms of the campaign or to modify or withdraw the campaign at any time.
RMHC’s decision in all campaign matters is final and no correspondence will be entered into.
By entering a Moment you agree to these Terms which will at that time become binding between you and RMHC.
These Terms shall be exclusively governed by and construed in accordance with the laws of England and the courts of England and Wales will have exclusive jurisdiction in the event of any dispute.
